• Paid advertising on Meta (Facebook, Instagram) and Google Ads

• Landing page development and conversion optimization

• CRM integrations, analytics reporting, and automation support

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

2. Eligibility

To use our services, you must:

• Be at least 18 years of age

• Have the legal authority to enter into contracts under applicable laws (including Indian law)

• Be representing a legitimate business or organization

3. Client Responsibilities

As a client of Digital Wizards Media, you agree to:

• Provide accurate, lawful, and up-to-date business information

• Use data and leads only for your own business marketing purposes

• Not resell, share, or misuse the leads or reports provided

• Comply with all applicable advertising policies (e.g., Meta Ads Policy, Google Ads Guidelines), data protection laws (e.g., GDPR, India IT Act), and email/SMS marketing regulations (e.g., CAN-SPAM, PECR)

4. Payments and Refunds

• All payments must be made in Indian Rupees (INR), unless otherwise agreed.

• Services are invoiced in advance unless stated differently in writing.

• Once a campaign has commenced or lead data has been delivered, no refunds will be issued.

• We reserve the right to suspend or terminate services in case of delayed or non-payment.

5. Leads & Performance Disclaimer

While we aim to provide high-quality, relevant leads, you acknowledge and agree that:

• We do not guarantee conversions or sales from leads

• Lead exclusivity is not assured unless explicitly agreed in writing

• We are not liable for business outcomes or client-side platform issues (e.g., CRM errors, platform bans)

6. Intellectual Property

All strategies, content, creative assets, and digital frameworks created by Digital Wizards Media remain our intellectual property, unless explicitly transferred in writing.

You may not copy, reproduce, distribute, or use our content without prior written permission.

7. Data Use & Privacy

We collect and process data in accordance with our Privacy Policy. By using our services, you consent to:

• The collection, use, and processing of data for lead generation and marketing

• Communications via email, phone, or WhatsApp related to our services

Clients targeting UK, EU, or US customers must also comply with GDPR/PECR/CCPA where applicable.

8. Termination

We may immediately suspend or terminate your services if:

• You breach these Terms

• You misuse our data, platform access, or services

• You cause reputational or financial harm to our company

Either party may terminate the agreement with written notice and payment of any outstanding dues.

9. Disclaimers

All services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

We make no guarantees of marketing performance or return on ad spend (ROAS).

10. Limitation of Liability

To the maximum extent permitted by law, our liability shall be limited to the amount paid by you for the specific service giving rise to the claim. We are not liable for:

• Indirect, incidental, or consequential damages

• Third-party platform failures (e.g., Meta or Google suspensions)

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of the competent courts in Bangalore, Karnataka.

International clients agree that they are entering into an agreement under Indian law.

12. Modifications to Terms

We reserve the right to amend these Terms at any time. Continued use of our services following such changes will constitute your acceptance of the updated Terms.
